TERMS OF USE
This document is an electronic record in terms of the Information Technology Act, 2000 ("IT Act") and the rules made thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023 ("DPDP Act"). This electronic record does not require any physical or digital signature.
These Terms of Use ("Terms") govern your access to and use of the Murm mobile application, website, and related services (collectively, the "Platform"), operated by Murmit Technologies India Private Limited, a company incorporated under the Companies Act, 2013, having its registered office in India (hereinafter referred to as "Murm", "Company", "We", "Us", or "Our").
By accessing or using the Platform, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Platform.
1. Nature of the Platform
1.1 Murm is a digital emotional check-in platform that enables users to:
- Log in using third-party authentication services (Google, Apple ID, Facebook);
- Provide personal details including date of birth, email address, and phone number;
- Perform voluntary emotional check-ins;
- Add trusted contacts; and
- Enable notifications to such trusted contacts if the user does not check in within a defined time period.
1.2 Murm is a technology platform and does not provide medical, psychological, psychiatric, counselling, crisis intervention, or emergency services.
1.3 Murm does not:
- Diagnose, treat, or monitor medical or mental health conditions;
- Provide professional advice;
- Guarantee response or intervention by trusted contacts.
1.4 Users acknowledge that the Platform is intended solely as a notification and presence-enablement tool.
2. Eligibility
2.1 In accordance with the Indian Contract Act, 1872, you represent and warrant that:
- You are at least 18 years of age; and
- You are competent to enter into a legally binding agreement.
2.2 The Platform is not intended for minors. If you are under 18 years of age, you may use the Platform only under parental or guardian supervision.
3. Account Registration and Authentication
3.1 Users may create an account using:
- Google Sign-In
- Apple ID
- Facebook Login
3.2 During registration, the Company may collect:
- Date of Birth
- Email address
- Phone number
3.3 You agree that all information provided is accurate, current, and complete.
3.4 You are responsible for safeguarding your account credentials and for all activities conducted under your account.

4. User Responsibilities
4.1 You agree to use the Platform in compliance with:
- The Information Technology Act, 2000;
- The DPDP Act, 2023;
- The Indian Penal Code, 1860 (as amended);
- Any other applicable laws in India.
4.2 You shall not:
- Add trusted contacts without their knowledge;
- Provide false information;
- Attempt to disrupt, reverse engineer, or compromise the Platform;
- Use the Platform for unlawful, abusive, or fraudulent purposes.
4.3 You are solely responsible for the correctness of trusted contact details and any consequences arising from notifications sent to them.
5. Emotional Check-In Functionality
5.1 The check-in feature is voluntary.
5.2 If you fail to check in within the configured period, Murm may notify your selected trusted contact.
5.3 Murm does not guarantee:
- Delivery of notifications without interruption;
- Response from trusted contacts;
- Safety, welfare, or intervention outcomes.
5.4 You expressly acknowledge that Murm is not an emergency service under any applicable Indian law and should not be relied upon for crisis response.
6. Data Collection and Storage
6.1 Murm collects and processes personal data in accordance with:
- The Digital Personal Data Protection Act, 2023;
- The IT Act, 2000 and associated rules.
6.2 Data stored may include:
- Account information (DOB, email, phone number);
- Check-in logs;
- Trusted contact information.
6.3 Data is processed for the limited purpose of operating the Platform and delivering notifications.
6.4 Data retention policies are detailed in the Privacy Policy.
7. Account Deletion
7.1 Users may request deletion of their account by writing to:

7.2 Upon verification, the Company will process deletion within 7 (seven) business days, subject to:
- Compliance with statutory retention requirements;
- Legal or regulatory obligations.
7.3 Once deleted, the account and associated data cannot be restored.
8. Intellectual Property
8.1 All content, trademarks, logos, design elements, source code, and software associated with the Platform are protected under:
- The Copyright Act, 1957;
- The Trade Marks Act, 1999;
- Applicable intellectual property laws in India.
8.2 Unauthorized reproduction, distribution, modification, or commercial use is strictly prohibited.
9. Disclaimer of Warranties
9.1 The Platform is provided on an "as is" and "as available" basis.
9.2 To the fullest extent permitted under applicable law, the Company disclaims all warranties, including:
- Fitness for a particular purpose;
- Continuous availability;
- Accuracy or reliability of notifications.
9.3 The Company shall not be responsible for interruptions caused by:
- Force majeure events;
- Network failures;
- Third-party service disruptions.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, Murmit Technologies India Private Limited shall not be liable for:
- Indirect, incidental, special, or consequential damages;
- Emotional distress;
- Personal injury;
- Failure of trusted contacts to respond;
- Data loss not caused by Company negligence.
10.2 The Company's total liability shall not exceed the amount paid (if any) by the user for use of the Platform in the preceding 12 months.
11. Indemnification
You agree to indemnify and hold harmless Murmit Technologies India Private Limited, its directors, officers, employees, and affiliates from any claims, losses, damages, or liabilities arising out of:
- Your misuse of the Platform;
- Violation of these Terms;
- Violation of applicable law.
12. Suspension and Termination
12.1 The Company may suspend or terminate access if:
- You breach these Terms;
- You engage in unlawful or abusive conduct;
- There is suspected misuse.
12.2 Termination does not affect accrued rights or liabilities.
13. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts located in Bengaluru, Karnataka, India.
14. Grievance Redressal Mechanism
In compliance with the IT Act and Consumer Protection (E-Commerce) Rules, 2020:

Grievances will be acknowledged within 48 hours and resolved within 30 days, where feasible.
15. Amendments
The Company reserves the right to modify these Terms. Continued use of the Platform after modifications constitutes acceptance of the revised Terms.
